These Terms and Conditions ("Terms") govern your use of the KidGigs application (the "Application"). By accessing or using the Application, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Application.
1. Use of the Application
• Purpose: The Application is an online platform that allows users to post and find opportunities for local tasks to be completed by minors (Minors). The Application serves as a posting board and does not certify the suitability of any task or the competence of any Minor to perform a task.
• User Roles:
○ Parents/Guardians: Parents/Guardians (Parent) can register their children on the Application and approve or deny tasks posted for their children (Parental Consent). They can also act as Task Posters, described below.
○ Minors: Minors can be allowed to register on the Application (with Parental Consent) and use the Application to find and accept tasks.
○ College Students (18-24) Can register in the application and find and accept tasks
○ Task Posters: Users can post tasks on the Application to be completed by minors.
2. User Responsibilities
• Parent/Guardian Responsibilities:
○ You are solely responsible for the actions of your child while using the Application.
○ You must review and approve all tasks accepted by your child.
○ You must ensure your child is capable of safely and competently performing any accepted task.
○ You understand that the Application does not guarantee the safety or suitability of any task.
○ You must use your best judgment about having your child go to the location to perform the task and for your child to engage with the Task Poster if necessary.
○ You are also responsible for ensuring that your child is properly paid for the task completed and the Application does not have payment processing capabilities.
○ You are responsible for making sure your child is not performing too many tasks and that they are within any legal limits for children, as the Application doesn’t track these limits.
○ By registering a Minor, you, the Parent, represent and warrant that any identifying information, such as name and date of birth, that may be submitted by you, the Parent, regarding the Minor’s identity is also true, correct, and complete. We may restrict, suspend, or terminate your access at any time to the Application if directed by a Federal or State regulator having jurisdiction over us issuer, or if we reasonably suspect that you have engaged in fraud, or other illegal activity, or if you have breached these Terms of Service
• Minor Responsibilities:
○ You must use the Application responsibly and comply with these Terms.
○ You must obtain parental/guardian consent before accepting any task.
○ You must complete accepted tasks to the best of your ability.
○ You must be respectful of the Task Poster’s property and do no harm to people or property in the completion of the tasks.
○ If you need assistance in completing a task or additional instructions please ask your parent or the Task Poster for guidance.
○ You must return all tools, keys, etc. provided to you in order to complete the task.
○ Select tasks you can and want to complete.
○ You must make sure you are not completing too many tasks that it causes issues with school and other activities.
• Task Poster Responsibilities:
○ You must accurately and clearly describe the task and any relevant safety precautions.
○ You must ensure that the task can be reasonably completed by a child in the time needed.
○ You must comply with all applicable laws and regulations.
○ You must render payment to the child upon completion or as otherwise agreed to.
• AB 5-aware and minor-safe
○ 1) What KidGigs is (and isn’t) – KidGigs operates a referral and communications platform for families and neighbors to arrange occasional, household-type help by teens ages 12–17 (for example: babysitting, tutoring, lawn care with hand tools, dog walking). KidGigs does not hire, fire, supervise, set schedules, provide tools, or determine pay.
○ 2) No independent contractors for minors – Minors using KidGigs are not independent contractors of KidGigs or of any household. California guidance makes clear that the independent-contractor framework does not fit minors. Any use of the platform that attempts to treat a minor as a contractor is prohibited.
○ 3) No employment relationships via KidGigs – KidGigs is designed only for irregular, neighbor-to-neighbor help. The platform must not be used to create ongoing or regular employment arrangements with a minor. If a household intends ongoing employment or duties beyond simple, age-appropriate household help, they must not use KidGigs.
○ 4) No work permits on KidGigs (by design) – KidGigs does not support work-permit workflows, because the app limits gigs to irregular, casual tasks that do not require permits. If a request would require a permit or falls under wage-order/employee rules, it is outside scope and not allowed on KidGigs.
○ 5) AB 5’s ABC test addresses contractor vs employee status. KidGigs’ business is operating a marketplace/referral app, not providing the underlying services. In addition, because minors cannot be contractors, no KidGigs engagement classifies a minor as an independent contractor.
○ No employment relationship. Nothing in these Terms creates an employer–employee, joint venture, or agency relationship between KidGigs and Users. Users are solely responsible for their tax filings, insurance, tools, licenses, and compliance with applicable law.
3. Payment and Transactions
• 3.1 Payment methods
Requesters may pay for completed tasks in cash or by credit card through the Application.
• 3.2 Card processing (Stripe)
Credit card payments are processed by Stripe. By choosing card payment, the Requester authorizes Stripe to charge the card for the task amount, plus any platform and processing fees shown at checkout. KidGigs does not store full card numbers; Stripe handles card data and PCI compliance.
• 3.3 Disbursement
For card payments, KidGigs facilitates transfer of funds to the teen’s parent or legal guardian as the designated payee. KidGigs acts as a limited payment collection agent for the Requester solely to accept and transmit authorized payments. This role does not make KidGigs the employer, joint employer, or a labor broker.
• 3.4 Fees
KidGigs may charge a platform fee and pass through Stripe processing fees. All applicable fees are disclosed before payment confirmation.
• 3.5 No wages, payroll, or employment services
KidGigs does not set wage rates, schedule shifts, calculate or remit payroll, provide benefits, or supervise work. Using card payments does not create an employment relationship between KidGigs and any User.
• 3.6 Refunds and disputes
For card payments, KidGigs may, at its discretion and under its policies, hold, release, or refund amounts. Cash payments are outside KidGigs’ control and must be resolved directly between the parties.
• 3.7 Taxes
Requesters are responsible for any taxes or reporting related to their payments. KidGigs does not provide tax, payroll, or employment advice
• .3.8 Prohibited uses
Do not use KidGigs to arrange ongoing or regular employment, any driving or vehicle-based tasks, or tasks that would violate these Terms. If a posting would require employment onboarding or a work permit, it is not permitted on KidGigs.
4. Privacy
• Minor Privacy: The privacy of minors is of utmost importance. The Application will collect and use personal information from minors only with the consent of their parents/guardians and as otherwise described in our Privacy Policy.
• Data Security: The Application will take reasonable measures to protect the personal information of users.
• Artificial Intelligence: The Application may use artificial intelligence for the purposes of matching tasks with profiles based on a number of factors and pieces of information. This matching is meant to improve your experience with the Application and will not prevent you from finding matches manually.
5. Disclaimer of Warranties
• Use at Your Own Risk: The Application and its contents are provided "as is" and "as available" without warranty of any kind, express or implied. While we do allow adults to verify who they are using a third-party tool you are responsible for making sure you are comfortable with your children engaging with the Task Poster.
• No Guarantees: The Application does not guarantee the safety, suitability, or successful completion of any task.
• No Endorsement: The Application does not endorse any task, task poster, or minor.
6. Limitation of Liability
In no event shall the Application or its developers be liable for any damages whatsoever, including but not limited to direct, indirect, incidental, consequential, or punitive damages, arising out of or in connection with the use of the Application or in the performance of the task
7. Indemnification
You agree to indemnify and hold harmless the Application and its developers from any and all claims, liabilities, damages, and expenses (including attorneys' fees) arising out of your use of the Application, while performing the tasks, or your violation of these Terms
8. Modifications
The Application reserves the right to modify these Terms at any time without prior notice. Your continued use of the Application following any such modification constitutes your acceptance of the new Terms.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of California.
